Planning & Development

The Council's planning and development duties involved a wide range of functions ranging from:

  • Strategic planning
  • Preparation and administration of local environmental plans and development control plans
  • Assessing development applications and issuing development consents
  • Issuing complying development certificates and construction certificates
  • Issuing approvals for the connection of premises to water supplies and sewerage systems
  • Issuing approvals for a wide range of activities as delegated by various Acts and Regulations.

Local Environment Plan 2001

Cobar Shire Council's Local Environmental Plan was published in Government Gazette No 93 of 1st June 2001.  The aims of this plan are to:

  • Repeal all the existing local environmental plans and planning instruments which apply to land within the local government area of Cobar and to consolidate and update the Council's planning controls in a new local environmental plan, and
  • To provide for exempt and complying development and thereby provide exemption from State Environmental Planning Policy No 60—Exempt and Complying Development while preserving exemption from clauses 6–10 of State Environmental Planning Policy No 4—Development Without Consent, and
  • Outline planning controls which are clear and explicit but also provide flexibility in their application, and
  • Conserve and protect Aboriginal heritage, and
  • Conserve and protect the environmental heritage and natural resources of Cobar, and
  • Promote and encourage ecologically sustainable development, and
  • Provide a framework for more detailed controls to be contained within development control plans, and
  • Provide opportunities for public participation in the environmental planning and development process.

Draft Local Environmental Plan 2011

The Draft Cobar Local Environmental Plan 2011 (LEP) and supporting documents will be on public exhibition from 7 July 2011 until 2.30pm on the 4 August 2011 at the Cobar Shire Council Administration Office, 36 Linsley Street between the hours of 8.00am to 4.00pm (weekends excepted).

Under NSW Government reforms, all NSW councils are required to prepare a new comprehensive Local Environment Plan in accordance with the State Government's standard Local Environmental Plan template (Standard Instrument).

Council's Draft LEP has been certified by the NSW Government for public exhibition. The preparation of Council's Draft LEP has included a process of transferring Council's existing Local Environmental Plan, the Cobar Local Environmental Plan 2001 into the new Local Environmental Plan format.

When made, the Cobar Local Environmental Plan 2011 will control development and guide planning decisions made by Council.

A report reviewing the submissions received at the conclusion of the exhibition period will be considered by Council. It is anticipated that the report will be presented to Council at its Ordinary Meeting in August 2011.

Any person may, during the exhibition period, make submissions to Council with respect to the provisions of the draft Cobar Local Environmental Plan 2011. Submissions must be in writing and be received by 2.30pm on 4 August 2011.

Is not the subject of an Opinion by Parliament Counsel that the plan may be legally made and therefore the draft LEP may be changed to satisfy legal drafting requirements and,

includes Natural Resource maps which contain some anomolies and may be corrected at the conclusion of the exhibition period.

Development Control Plan No. 2/2002 

Note: This Policy must be read in conjunction with the State Environmental Planning Policy (SEPP) www.legislation.nsw.gov.au/maintop/view/inforce/epi+572+2008+cd+0+N which in particluar circumstances overides the provisions within Councils DCP No.2/2002.

Cobar Shire Council's Development Control Plan No. 2/2002 Exempt and Complying Development was adopted at its ordinary meeting held on Thursday 25th July 2002.

The aim of the plan is to identify development that is exempt and complying development within Cobar Shire. The Plan specifies Council's polices and requirements for the assessment of exempt and complying development.

This Plan applies to all land within the local government area of Cobar Shire as identified in the Cobar Local Environmental Plan 2001.

Objectives of the Plan are to:

  • Identify the type of exempt development, having minimal environmental impact, that can be carried out without development consent and without an environmental assessment under the Environmental Planning and Assessment Act 1979.
  • Set out the planning requirements and standards for exempt development.
  • Set out the planning outcomes and standards for complying development.
  • Set out the standard conditions to be attached to complying development certificates.
